BART, AC Transit and Capitol Corridor — eBikes on Trains and Buses

All three of Berkeley's transit systems take a bike, and the rules turn on the car you board and the bike's size.

BART. You can board at three Berkeley stations on BART's list: Ashby, Downtown Berkeley and North Berkeley. BART's bike FAQ answers: "Yes, Class 1, 2, and 3 e-bikes are allowed on BART, subject to the BART Bike rules." Those rules keep bikes out of "the first car or any crowded car," while "Folded bikes are allowed in all cars at all times."

AC Transit. If you take the bus, its racks take two-wheeled bikes "with a wheelbase of up to 44 inches and a wheel size of at least 16 inches, weighing up to approximately 75 pounds, with a maximum tire width of 3.2 inches."

Capitol Corridor. The train stops at Berkeley, and its bike page lists "Electric bikes" among what you may bring aboard, with BikeLink eLockers at the Berkeley station at "5 cents an hour."

Check two numbers before you rely on the bus. A fat-tire or cargo e-bike can miss AC Transit's 3.2-inch tire and 75-pound limits, while BART takes it outside the first car.

Trail Access — Regional Parks, the Bay Trail and the Marina

Two agencies write Berkeley's trail rules: the East Bay Regional Park District for the hills and the shoreline park, and the City for its own parks, paths and Marina.

The regional parks

The District's biking page and Ordinance 38 allow "Class I Electric Bicycles on park district trails that allow use of conventional bicycles and Class II electric bicycles on paved regional trails." Section 902.2 counts a Class III e-bike as a motor vehicle, which § 902.1 keeps to "established paved roads which are open to the public," and § 409.8(e) keeps every bicycle off cross-country routes.

Its Class II list includes the San Francisco Bay Regional Trail and the paved sections of the Wildcat Creek trail, Nimitz Way among them. Its Attachment A lists where "Bicycles are Not Permitted," among them Claremont Canyon Regional Preserve and the interior trails of the Berkeley Meadow in McLaughlin Eastshore State Park.

City parks, paths and the Marina

In City parks, § 6.32.060 makes it unlawful to operate a vehicle "in parks and on public paths except on roadways designated for vehicular use," and § 6.32.010 says that "a bicycle shall be deemed a vehicle" for that chapter. At the Marina, § 6.20.250 bars bicycles from paths, piers and docks "other than on paths so designated for their specific use."

Section 6.28.190 keeps bicycles off "the wooden walkways or wharfs in the Berkeley Yacht Harbor," and § 6.32.095 says people on bicycles "are not allowed within any skate park."

Where riders get caught out: in the regional parks a Class 3 counts as a motor vehicle, so it stays on the park roads open to cars and off every trail, the paved Bay Trail included, where a Class 2 may ride.

California eBike Laws — What Makes an eBike Legal in Berkeley

The state sets the classes and who may ride them. Berkeley adds sidewalk and park rules written for "motorized bicycles," a stretch of Solano Avenue closed to bikes, and, since 2026, no bicycle license.

The state definition

Vehicle Code § 312.5(a) defines an electric bicycle as one with "fully operable pedals and an electric motor that does not exceed 750 watts of power."

Because § 24016(b) says an electric bicycle "is not a motor vehicle," you need no plate, registration or driver's license. Section 21200 gives you "all the rights" of a driver on the road, with the duties to match.

On a Class 3, § 21213 applies: "A person under 16 years of age shall not operate a class 3 electric bicycle." A rider under 18 without a helmet faces a fine of "not more than twenty-five dollars ($25)" under § 21212.

Sidewalks: § 14.68.120, read both ways

Section 14.68.120 says: "No person shall ride or operate a motorized bicycle or motorized scooter on any sidewalk in the City." The chapter's 1970s definition in § 14.68.010 describes a "motorized bicycle" with "fully operative pedals" and a motor under "two gross brake horsepower," and read literally it can reach a pedal e-bike, whose 750-watt ceiling is about one horsepower.

Read with § 312.5, which calls a legal e-bike "a bicycle," the rule that applies is § 14.68.130 instead, which lets only juveniles ride a sidewalk, and never in front of schools, stores or businesses. Either way, an adult on an e-bike belongs on the street.

Parks, playgrounds and Solano Avenue

Under § 14.68.140, you may not ride a bicycle or motorized bicycle "upon any playground, park, or school ground where children are playing" without permission. Section 14.24.190 makes it unlawful "to ride, push or wheel a bicycle on the Solano Avenue roadway between Del Norte Street and Contra Costa Avenue."

The license rule, now gone

On January 20, 2026, the City Manager's staff report asked the Council to repeal the bicycle-licensing sections, citing Vehicle Code § 39002(a). Ordinance 7997-NS (2026) did so: Chapter 14.68 now holds only the definitions and the riding rules, so you need no City license.

What changes on January 1, 2027

Two bills signed on September 30, 2026 take effect on January 1, 2027, under the California Constitution's Article IV, § 8. AB 2346, Chapter 842, will set "10 miles per hour" as the prima facie limit "for a sidewalk" and let cities post 10, 15 or 20 mph on bike paths and multiuse trails.

From that date, SB 1167, Chapter 846, will allow a "walk mode" on Class 1 and Class 3 bikes "up to a maximum speed of 3.7 miles per hour," and will bar any vehicle "with motor power of more than 750 watts" from being "advertised, sold, offered for sale, or labeled" as an electric bicycle.

What it costs to get it wrong

Under § 1.20.020, a City code violation may be charged "as a misdemeanor or an infraction." An infraction carries "A fine not exceeding one hundred dollars for a first violation," up to two hundred for the second and up to five hundred for each more within a year.

What the code does not say

The Berkeley Municipal Code is "current through Ordinance 8031-NS, passed July 28, 2026." Across Titles 6, 12, 13, 14 and 16, which hold its parks, Marina and traffic rules, "electric bicycle" appears three times, all in the shared-micromobility permit chapter, § 14.63, and "e-bike" not once. A machine "intended by the manufacturer to be modifiable" past 20 mph on motor power, or past 750 watts, is not an e-bike under § 312.5(d).

The short rule in Berkeley: ride the street and the bike lanes, keep off sidewalks, use only paths marked for bikes at the Marina, and keep a Class 3 off the regional park trails.

Rebates

Ava Community Energy. Ava's Bike Electric program is open to any resident of Alameda County 18 or older and enters you in monthly drawings; the next is October 27, 2026. A winning code takes $400 off a standard e-bike, or $1,000 for an income-qualified buyer, and $900 or $1,500 off a cargo or adaptive model.

Income-qualified means a household enrolled in CARE, FERA or the Energy Assistance Program, and those buyers also get $250 toward a helmet, locks and lights. You redeem the code in person at a participating shop within 60 days. Ava's August 3, 2026 notice extended the program "for one more year," and the City's own notice points Berkeley residents to the lottery.

The state and the Air District. The statewide California E-Bike Incentive Project "began in December 2022 and concluded in December 2025." The Bay Area Air District, whose nine counties include Alameda, runs Clean Cars for All, which gives income-qualified residents who retire an older car "a pre-paid card for public transit or e-bikes."

You can rent an e-bike at Rad Power Bikes' Berkeley store for $75 a half day or $115 a full day, per its store page, and you can test-ride one free.
