These Terms of Service ("Terms") are an agreement between you and Zeus eBikes Inc., a Florida corporation doing business as Redtail Ebikes ("Redtail Ebikes," "we," "us," or "our"). By using this website or placing an order, you agree to these Terms. Please read them carefully.

Who may use our store

You must be at least 18 years old and able to form a binding contract to purchase from us. If you create an account, you are responsible for keeping your login details secure and for all activity that happens under your account.

Orders & pricing

All prices are in U.S. dollars. We strive for accuracy but may correct errors in pricing or descriptions and may refuse or cancel any order, including after it is placed. If we cancel an order you have already paid for, we will refund you in full. Promotions may change or end at any time. Placing an order is an offer to buy; our acceptance occurs when we ship the item.

Shipping, delivery & damage in transit

Delivery dates are estimates, not guarantees. Please inspect your shipment before signing for it. If the box or product shows visible damage, note the damage on the carrier's delivery paperwork and contact us within 48 hours with photographs so we can file a freight claim on your behalf. Reporting transit damage late can prevent us from recovering it from the carrier. See our Shipping Policy for full details.

Returns & refunds

Returns, exchanges, and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms.

Electric bike use & local laws

You are responsible for operating your e-bike legally and safely. E-bike classifications, speed limits, age requirements, helmet rules, licensing, and where you may ride vary by state and municipality. It is your responsibility to understand and comply with the laws that apply to you. Always ride safely and wear appropriate protective gear.

Assumption of risk

Riding an electric bicycle involves inherent risks, including the risk of serious injury or death. By purchasing from us, you acknowledge these risks and accept responsibility for riding within your ability, maintaining your bike in safe working order, following the manufacturer's instructions and safety warnings, and ensuring that anyone you allow to ride your bike does the same. Modifying a bike or its controller, battery, or speed limiter may make it unsafe, void the manufacturer's warranty, and render it illegal to ride in your area.

Battery safety

Lithium-ion batteries must be charged, stored, and transported according to the manufacturer's instructions, using the charger supplied with the product. Do not charge a damaged, swollen, or wet battery, and do not leave a charging battery unattended.

Warranty

Redtail Ebikes is an independent retailer, not a manufacturer. Products are covered by the manufacturer's warranty where applicable, and the manufacturer's warranty terms govern that coverage. We will help facilitate warranty claims with the manufacturer, but we do not provide the warranty ourselves.

Disclaimer

Except for warranties that cannot be excluded under applicable law, and except for any manufacturer's warranty that comes with a product, our products and this website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Redtail Ebikes is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, arising from the use of our products or website, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to a product or order will not exceed the amount you paid us for that product or order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Redtail Ebikes and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your use or operation of a product purchased from us.

Intellectual property

The content on this website — including text, product descriptions, photographs, graphics, logos, and the site's design — is owned by or licensed to us and is protected by copyright and trademark law. Governing law & disputes

You agree that any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small claims court, or limits any rights you may have under the consumer protection laws of the state where you live.

Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding your use of this website and your purchases.

We may update these Terms from time to time. We will post the revised Terms on this website and update the "Last updated" date. Your continued use of the website after we post changes constitutes acceptance of the revised Terms.
