Section 18-79(a) provides that no person shall ride, drive or propel any bicycle, tricycle, skateboard, roller skates, roller blades or similar nonmotorized equipment "on any but the regular vehicular roads or paved pathways and trails designated for said purpose," and adds that no person shall deviate from the traffic provisions governing bicycles while on park property.

Section 18-77(a) is broader still: no person propelling "any vehicle, motorized, horse-drawn or self-propelled" may use anything other than the regularly designated paved or improved park roads or driveways. Both carve out wheelchairs and mobility devices for people with a mobility impairment.

An e-bike is not literally "nonmotorized equipment," and it is not a registered motorized vehicle either, since Florida exempts it from registration. Section 18-76 closes that gap in the city's favor by applying "the traffic ordinances of the city and applicable state vehicle laws, F.S. ch. 316" throughout park property, and § 316.20655(1) makes an electric bicycle a vehicle to the same extent as a bicycle.

The practical instruction is one line: in a Miami Gardens park, stay on the roads, paved paths and designated trails.

The penalty is real rather than theoretical. Section 18-79(d) sets $100 for a first violation and $200 for each one after, and holds parents and guardians strictly accountable for the actions of minors. Everything public, everywhere in the city. Read on its own, that sounds like it might reach an e-bike.

It does not, and the reason is one word in the definitions. Sec. 24-79 defines the banned motorized scooter as a vehicle "not having a seat or saddle," and the code's motor-vehicle definitions exclude bicycles outright. A legal e-bike has a saddle, operable pedals and a motor under 750 watts, which puts it outside every banned class and back under the state framework.

The machine that ordinance was written for is the one sold beside e-bikes at too many counters. That is the distinction to hold onto at the till.

What is not an e-bike here, with teeth

Electric dirt bikes in the Surron and Talaria mold generally exceed 750 watts or lack operable pedals, which puts them outside § 316.003(23) everywhere in Florida.

In this city they land somewhere worse than merely unregulated.
