VTA — eBikes on Buses and Light Rail
Santa Clara Valley Transportation Authority publishes its bicycle rules on its own Biking page, read on September 4, 2026, and one sentence decides whether your bike is allowed at all: "Only human powered and sealed dry or gel cell electric assisted bicycles are allowed." A sealed-battery e-bike is inside that rule. No extra fare is charged for the bike, but the rider pays the ordinary fare.
On the bus, you secure the bike yourself in the exterior rack. VTA permits a bicycle inside the bus at the driver's discretion when the bus has no fully operational rack or the exterior rack is already full, with a maximum of two bicycles inside and only if the passenger load allows safe boarding. A bike carried inside stays attended.
On light rail, the maximum is six bicycles per vehicle: four in the racks provided, plus two standing on the floor in the center turntable area. Bikes board through the center doors of each car and stay in that designated center section. On platforms, VTA requires bikes to be walked rather than ridden, and bikes may not be chained to poles or pillars.
For anyone leaving the bike behind, VTA runs 500 bike lockers at light rail and Caltrain stations, park-and-ride lots and transit centers, with no rental charge and a $25 refundable deposit.
Check the battery, not the scale. VTA's admission rule turns on a sealed dry or gel cell battery rather than on a published weight limit, and the agency states none on its Biking page. Board through the center doors on light rail, let other passengers on and off first, and expect the rack to be full at commute times.
Trail Access — The Guadalupe River and Los Gatos Creek Trails
The paved river trails carry most of the city's e-bike miles, and they are park land. The Guadalupe River Trail runs the spine of the valley floor past downtown, and the Los Gatos Creek Trail heads south toward Campbell. Which is where San Jose does have something to say.
Fifteen miles per hour, for anything with wheels
San Jose Municipal Code § 13.44.100(C) bars operating any vehicle on a road, street, trail or highway in a city park faster than the posted limit, "or if no speed is posted, at a speed greater than fifteen miles per hour." That is not an e-bike rule and it does not care about your class. A Class 1 bike assists to 20 mph, so the cap is a riding habit rather than a purchase constraint.
The sign grants permission; its absence does not
Section 13.44.100(D) runs the opposite way to most riders' assumption, in its own words:
"The director may designate areas, paths, roads or trails in any city park or recreation area where the riding of bicycles, motorcycles, minibikes, or like vehicles may be permitted. No person shall ride or take any bicycle, motorcycle, minibike or like vehicle upon or in any area, path, road or trail in any city park or recreation area unless such activity is permitted by notices posted by the director."
Read that as a rider: park riding is prohibited unless a posted notice permits it. In practice the major paved trails are signed and open, which is why both river trails carry commuters every morning. The rule bites on unsigned side paths and levee tracks, so check the board at the trailhead before you turn off the pavement.
An e-bike sits comfortably inside "like vehicle," and state law backs the city here rather than overriding it. California Vehicle Code § 21113(g) lets a public agency regulate electric bicycles on property it controls, and § 21207.5 lets local authorities restrict equestrian, hiking and recreational trails. The trailhead sign is the rule. San Jose parks default to closed for riding and open where a notice says so, and the speed default where nothing is posted is 15 mph for any vehicle. Photograph the board the first time you ride a new trail; the designation can differ from one park to the next.
California eBike Laws — What Makes an eBike Legal in San Jose
Two layers, and only one of them is local. The state defines the bike; the city defines the park. Nothing in between applies to a privately owned e-bike.
The state definition
Under California Vehicle Code § 312.5, an electric bicycle has fully operable pedals and a motor of 750 watts or less, in three classes: Class 1 pedal-assist to 20 mph, Class 2 throttle-assisted to 20 mph, and Class 3 pedal-assist to 28 mph with a speedometer. No license, registration or insurance is required for any class.
Anything above 750 watts, or built to run past 28 mph, is a motor vehicle, and none of this applies to it. California e-bike laws carries the statewide rulebook, including the 2026 battery-certification and reflector changes.
What the city code does not say
San Jose's traffic title opens with a definitions chapter that governs everything after it. Section 11.04.010 provides that "the definitions set forth in this chapter shall govern the application and interpretation of Title 11," and § 11.04.021 defines a bicycle as "a device upon which any person may ride, propelled exclusively by human power through a belt, chain, or gears, having one or more wheels."
Propelled exclusively by human power. An e-bike is not that, and the title never defines one separately: across the definitions chapter, the bicycles chapter, the shared micro-mobility chapter and the parks chapter, the phrase "electric bicycle" appears zero times, and so does "e-bike."
The chapter that trips people up is the rental one. Chapter 11.92, adopted in January 2019, defines a shared micro-mobility device as a transportation device "that is displayed, offered or placed for rent in any Public Area or Public Right-of-Way." Rented. Your own bike is not one, and the chapter's impoundment powers point at fleet operators.
The record your shop hands you
One San Jose ordinance is aimed straight at the businesses on this page. Section 11.72.080 provides that "each bicycle retailer shall supply to each purchaser a record of the following information: Name of retailer, address of retailer, year and make of bicycle, and serial number of bicycle," and bars selling a new bicycle without a serial number permanently stamped or cast on the frame.
Apply the definition above and the duty does not reach an electric bike on the code's own terms. Do it anyway: ask for the serial number in writing, photograph the frame number yourself, and keep both with the receipt. It is the only thing that turns a stolen-bike report from a description into an identification.
The money
There is no city rebate. The statewide voucher is finished: the California Air Resources Board states that its E-Bike Incentive Project "began in December 2022 and concluded in December 2025," whatever retailer blogs still say.
The regional program is open and much larger. The Bay Area Air Quality Management District runs Clean Cars for All across nine counties including Santa Clara, and it is a vehicle-retirement program: scrap an eligible older car and you may take the Mobility Options award of $7,500 as a pre-paid card for transit and e-bikes instead of a replacement vehicle.
It is income-qualified. The published household caps are $47,880 for one person, $64,920 for two, $81,960 for three and $99,000 for four, rising by $17,040 per additional person.
That will not suit a household that needs its car. For a commuter already thinking about giving one up, it is an order of magnitude past any coupon a shop floor can offer.

This is close to ideal commuter country: flat, dry most of the year, and threaded with paved trail that meets the street grid at dozens of points. The Guadalupe River Trail is the spine, running from the north of the city past downtown; the Los Gatos Creek Trail is the southern branch. Between them they turn a valley commute into a ride that mostly avoids arterial traffic. Trails near you covers the wider region.
Plan around two things. Summer heat costs battery range and rider comfort, which argues for more capacity than the commute strictly needs. And a bike that feels strained held at 15 mph will make the river trails unpleasant, which is a test-ride question rather than a spec-sheet one.
Before you drive across town
The seven floors are scattered, so an afternoon rarely covers more than three. Four questions make each visit count.
- Which class is it? Ask to see the class sticker on the frame. CVC § 312.5 is what everything else hangs on, and the answer belongs on the bike rather than in a sales conversation.
- Does it feel right held at 15 mph? That is the park cap, and a Class 1 will do 20 without effort. The bike you enjoy is the one that rides well below its own limit.
- Who services the motor? A floor built around one brand's mid-drive is not automatically set up for another maker's hub drive. The motor guide explains why that matters more than the badge on the down tube.

Are e-bikes street legal in San Jose?
Yes. A compliant Class 1, 2 or 3 e-bike is street legal under California Vehicle Code § 312.5, with a 750-watt ceiling and no license, registration or insurance. San Jose adds nothing of its own: its municipal code never uses the phrase "electric bicycle."

The California sweep built its statewide candidate list from 598 named bicycle shops in OpenStreetMap plus 354 rows from the state's approved-retailer roster, de-duplicated to 766 candidates across the 76 California cities above 100,000 residents in the Census Bureau's 2024 estimates. San Jose, population 997,368, contributed 12 mapped leads and one roster row.
Seven shops are listed because seven confirm the electric claim on their own live sites, read on August 30, 2026. Two of the seven, Fast Bicycle and Summit Bicycles, are mapped with no website recorded, so no automated pass could reach them; each site was resolved by hand and then read the same way. GP Sports appears in neither OpenStreetMap nor the state roster and surfaced only through the answer-engine panel, which is the argument for running one.
The city rules come from San Jose's Municipal Code on Municode, the city's designated publisher, codified through Ordinance No. 31330, enacted June 16, 2026, with the currency banner re-checked on the day of the read.
Municode is the sole publisher of that code, so every municipal claim rests on one publisher rather than two, and the ledger records it that way. The transit rules come from VTA's own Biking page, read September 4, 2026, which is likewise the sole publisher of its own rider rules.
